Last Will and Testament
Date, June 1, 1867- Filed, Aug. 12,1867
Record, Will Record No. 1 Page 33"In the name of God, Amen. I, Thomas Osborn, of Cedar, Mitchell County,Iowa, being of sound and disposing mind and memory, calling to mind the fraility and uncertainty of human life and being
desirous of settling my wordly affairs and directing how the Estate with which it has pleased God to bless me, shall be disposed of after my decease, while I have strength and capacity so to do, do make and publish this my last Will and Testament. And first I commend my mortal spirit to Him who gave it and my body to the Earth, to be buried with little expense or ostentation by my Executor herein after named. And as to my wordly Estate and all the property, real, personal or mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my decease, I devise, bequeath and dispose thereof in the manner following to-wit.
Imprimis. My will is that all my just debts and funeral charges shall, by my Executor herein after named, be paid out of my Estate as soon after my decease as shall by them be found convenient.Item. I give, bequeath and devise to my beloved wife Edith C. Osborn, my farm consisting of 160 acres described as follows, The Northeast Quarter of Section 32, Township 98, in Range 18 West, in Mitchell County and State of Iowa. Also a parcel of land bounded by a line commencing at the Southwest Corner of the Northwest Quarter of the Northeast Quarter of Section 21, in Township 98 North of Range 17 West and running thence East 40 rods, thence North 20 rods, thence West 40 rods, thence South 20 rods to the place of beginning, containing 5 acres more or less, being in the County of Mitchell and State of Iowa.
Item. One span of Horses, Wagon, Harness, Reaper, Two Plows, Dray, Three Cows, all my household furniture.
Item. I give, devise and bequeath to each of my children, Samuel Osborn, Julia C. Osborn, John W. Osborn, Ella Osborn, the sum of $5.00 to be paid to each of them as soon after my decease, but within one year, as conveniently may be done.
Item. I give, devise and bequeath to my son Charles A. Osborn, my gun.
Lastly. I do nominate and appoint my wife, Edith C. Osborn to be the Executrix of this my last Will and Testament .
In Testimony whereof I, the said Thomas Osborn have to this my Last Will and Testament subscribed my name this the first day of June A.D., 1867, Eighteen hundred and sixty-seven.
