Daniel Mulverhill died at his residence in Osage, Mitchell County, Iowa July 17, 1871.“In the name of God, Amen.
I, Daniel Mulverhill, of the village of Osage, in the County of Mitchell and State of Iowa, of the age of fifty-six years or thereabouts, and being of sound mind do make, publish and declare this, my last will and Testament in manner following, that is to say.First. I wish to be buried in the Osage Cemetery. I wish a good Head stone to be erected with a cross on the Stone after the manner of the Catholic Church. I wish also a good fence erected around the burial lot in said Cemetery. All to be finished up in a neat and nice shape, a neat fence well painted &c. The appropriation for these objects are to be first made out of my estate.
Second. I give and bequeath to my wife, Mary Mulverhill, all my town property consisting of my homestead and twelve lots beside. The homestead comprises six lots, also the cows and hogs
upon the place. All the other stock if any there be left shall be sold to apply upon debts. She is to have the household furniture. Everything about the barn except the two cows and hogs spoken of is to be sold to pay debts. She is also to have all the grain and provisions left.Third. All the rest of my property is to be sold to satisfy debts and make the following legacies and gifts and donations.
Fourth. I devise and bequeath to my sister, Bridget Reagen of Norwich, New London Co.,Connecticut, the sum of Fifty ($50.00) Dollars. If she is dead it is to go to her heirs.
Fifth. I devise and bequeath to my sister Mary Mulverhill, if she be living, the sum of fifty ($50.00) Dollars. Her P.O. address is at Six Mile Bridge, Clair County, Ireland. If she be not living this legacy shall fail.
Sixth. I devise five dollars to the priest to say mass for my soul.
Seventh. I devise and bequeath the sum of One Hundred Dollars to the purchase or erection of a Catholic Church in Osage.Eighth. If anything is left of my estate, after making these appropriations and paying the debts
it shall go to my wife, Mary Mulverhill.
Ninth. If there is not enough left of my estate, when I die, to satisfy all these matters set forth, then those last mentioned shall fail first and in their back to the beginning. Except the five dollars to the priest which shall be paid first after by burial expenses.Tenth. If any of these objects are satisfied before I die then the same shall be rendered inoperative upon the proper proof in court.
Eleventh. I appoint my brother sole executor of this my last Will & Testament. His name is
Cornelius Mulverhill.
