AFFIDAVIT: 1954.
I, Cyril Cornwell, being first duly sworn on oath depose and say that I am a resident of Osage, Mitchell County, Iowa, and have been such a resident for more than the past 20 years; that I was a grandson of Eliza A. Cornwell, who died a resident of Mitchell County, Iowa, on or about November 12, 1943 and whose estate was probated in Mitchell County, Iowa, the record thereof being found in Probate Record P, page 548, records of Michell County; that this Affidavit is given to explain the discrepancy between the list of heirs shown in the Eliza A. Cornwell estate, and the list of defendants in the foreclosure action brought by the State Board of Social Welfare, State of Iowa, found in District Court No. 17, pages 90-92, and complete record, No. 14, pages 413-414, records of Mitchell County;
That Lon Cornwell (one and the same person as Alonzo Cornwell), Mrs. Larry Dobson and Mrs. Frank Miller were all three children of Nora Dalzell and said Nora Dalzell was living at the time of the said forclosure action;
That Roy Cornwell, a son of Eliza A. Cornwell preceded his mother in death, leaving no Last Will and Testament and leaving as his sole and only heir at law Valerie Veltum (the wife of D. G. Veltum);
That Jessie Cornwell Markham, a daughter of said Eliza A. Cornwell, also preceded her mother in death leaving no issue but survived by her husband Frank Markham;
That Eliza A. Cornwell was my grandmother and I was a son of Herbert Lee Cornwell, son of said Eliza A. Cornwell, who also preceded his mother in death; that my father left no Last Will and Testament and left surviving him his widow, Nellie C. Cornwell and three children, Gladys Du-Bois, Mildred Olson and myself as his sole heirs at law.
I do further state that I know of my own knowledge that Donald A. Christensen and E. Lucille Christensen, husband and wife are now in possession of all of said real estate by conveyance; and that the said persons now in possession thereof together with their grantors and predecessors in said possession immediate and remote have been in continuous, exclusive, open, notorious, hostile, and adverse possession of all said described real estate under the claim of right and color of title since before January 1, 1940, and that no claim of any kind adverse to the possession and ownership of the said parties aforementioned is now pending or has been asserted or made as to any of the above described property nor against any of the owners or occupants thereof since before January 1, 1940.
