AFFIDAVIT: In Re Title to all of Block 5, Riceville, Iowa, except the East 6 rods thereof and Lot 2 of Lot 4 of the NE 1/4 25, 99, 15.

I, Esther Schmidt of Riceville, Mitchell County, Iowa, being first duly sworn on oath depose and say that I am a daughter of LaConda Banks, a resident of Mitchell County, Iowa, who died intestate on February 15, 1934 seized of an undivided one-half interest in the above described real estate.
I hereby state of my own personal knowledge, that my mother the said LaConda Banks, died as afore-stated on February 15, 1934; that her estate was never probated but that all claims, debts and funeral expenses chargable against her at the time of her death were paid in full.
That she left surviving her, her husband A. P. Banks, a resident of Mitchell County, Iowa, who died intestate on July 20,1940, seized of an undivided interest in said above real estate, and I hereby state that A. P. Banks, my said father who died on July 20, 1940, as afore-stated, left surviving no spouse and that his estate was never probated but that all claims and debts and funeral expenses of the said A. P. Banks chargeable against him at the time of his death were fully paid.

I hereby state that the following is a true and correct list of the only heirs and children of the said LaConda Banks, my mother and A. P.Banks my father:L. P. Banks, Esther Schmidt, Roland Banks, and Bessie Landis who are the sole surviving heirs and children of said decedents and all are of full age.
