DECLARATION FOR WIDOWS PENSION
STATE OF IOWA COUNTY OF DECATUR
On this 31 day of January, A.D. one thousand eight hundred and ninety-9 personally appeared before me, a Grant Kubler within and for the county and State aforesaid, Maria Davis, aged 58 yrs, a resident of Davis City, County of Decatur, State of Iowa, who, being duly sworn according to law, makes the following declaration in order to obtain pension under the provisions of the Act of Congress approved June 27, 1890. That she is the widow of John Davis, who was enlisted under the name of John Davis at Leon on the 22 day of Aug, 1862 as a private in Company K 39 Reg Iowa Inft and honorably discharged May 19, 1865, having served days or more during the late war of the rebellion. That the soldier was not in the military or naval service of the United States except as stated above. That soldier died from disease of kidneys one the disabilities for which he was drawing his. That she was married under the name of Maria Juett to said soldier at Mercer County Mo. on the 7 day of Oct, 1859 by William Argo J.P.; that there was no legal barrier to the marriage; that she had not been previously married; that the soldier had not been previously married. That the said soldier died December 19, 1898, His farm south of Davis City, Iowa that she was not divorced from him; that she had not remarried since his death. That the said soldier left the following-named children who are now-living and under sixteen years of age, to wit: Mary Charity Davis born Dec 22, 1883, at Davis City, Iowa That she hereby appoints J. H. Kling of Davis City Iowa, her true and lawful attorney, to prosecute this claim.

State of Iowa Decatur County ss:

In the matter of the pension claim of Maria Davis widow of John Davis deceased and late of Co. K 39th Reg. Iowa Vol. Inft.-Before me a Notary Public in and for the county and State aforesaid-personally appeared. W. W. Spargus, aged. 69 years, whose Post Office and residence is at Davis City Iowa; and J. M. Sylvester, aged 60 years, whose Post Office and residence is at Davis City Iowa, both of whom are well known to me, to be reputable and entitled to credit, and who being duly sworn declared in relation to the aforesaid cause as follows: That they were well and personally acquainted with John Davis, the soldier, above named and Maria Davis, that they lived together as husband and wife and raised a family of children. Mr W. W. Sparger states that he has been personally acquainted with the parties since in the spring of 1871-until the death of John Davis, in Dec. 1898.-and I know that during all of that time they were not separated, but maintained the relation of man and wife to each other and that Maria Davis has not remarried since the death of her late husband John Davis. Mr J. M. Sylvestor states that he has been acquainted with Maria Davis for more than 40 years, he knew her when a girl, before she was married and and knows she was never married but, to John Davis, the soldier above mentioned now deceased and that John Davis and Maria Davis lived together husband and wife until the date of his death. which was in Dec. 1898 and that he knows the said Maria Davis has not remarried since the the date of the death of her late husband John Davis. And both affiants here to state that they know that Charity Davis, the minor of John Davis and Maria Davis is still living and staying with her mother. We know the above statements to be true from our personal knowledge of the things to which we testify, as we have been neighbors during these years and we testify that the foregoing statements were written down by Geo. P. Campbell, from our oral statements made to him and who at our request reduced them to writing at his office in Davis City Ia at the time they were made. And we further declare that we have no interest either direct or indirect in the prosecution of this claim.
