KNOW ALL MEN BY THESE
PRESENTS:
Prior to
March 2, 1933, Minnie Sparks,
of McGregor,
Clayton, Iowa was the owner of the following described real estate,
located in Clayton County, Iowa and described as follows, to-wit:
Lots 18, 19, 20 and 21
in Block 14, James McGregor Jr., Addition to the Town of
McGregor, Clayton County, Iowa. |
WHEREAS, Minnie Sparks
of McGregor,
Iowa, has applied for assistance under and by virtue
of the old age assistance act, duly created and made a law of the
State by the Forth-fifth General Assembly in extraordinary session.
WHEREAS, Minnie Sparks
did on March 2, 1933,
convey by Warranty Deed the above described property to Kenneth
Sparks of McGregor, Iowa said deed being recorded on March 3, 1933;
WHEREAS, the above described
transfer of property ownership renders the said
Minnie Sparks ineligible
to receive old age assistance under the provisions of Section
5296-f13 of the old age assistance law;
WHEREAS, the undersigned
Kenneth Sparks, is the
son of the said
Minnie Sparks.
WHEREAS, Minnie Sparks
and Kenneth
Sparks are aware
of the error made in transferring the above described property
as respects the old age assistance act, and
are desirous of correcting the same;
NOW, THEREFORE, for and
in consideration the sum of One Dollar ($1.00) and other
valuable considerations and to render the said Minnie Sparks
eligible for assistance under and by virtue of
the old age assistance act as created and made a law by the
Forty-fifth General Assembly in extraordinary session and amended by
Senate File 357 Acts of the Forty-sixth General Assembly, the
receipt of which is hereby acknowledged; the undersigned,
Kenneth Sparks, does hereby grant and convey
unto the Iowa Old Age Assistance Commission a
grant of lien, under and
by virtue of the Old Age Assistance act, against the above described
property, viz:
Lots 18, 19, 20 and 21
in Block 14, James McGregor Jr., Addition to the Town of
McGregor, Clayton County, Iowa. |
for any and all sums of
money which may be received by the said Minnie Sparks from the Old
Age Assistance Commission, either as pension grants, funeral
benefits, or all such assistance so received , this lien to be of
the sum force and effect as though the title to said property were
still vested in Minnie Sparks at the time either or both of them
received said assistance; and the said Kenneth Sparks hereby
warrants and defends said property to be free and clear of all other
encumbrances whatsoever.
