$10,000 Suit Started Against Sac City Parties Delbert C. Browning, administrator of the estate of Melvin J Freeman, a late resident of Sac County, filed suit last week against George J. Hein and Dora Hein, of Sac City, for $10,000 with interest of 8% from March, 1934, and costs. The amount represents a promissory note given to Adrianna J. Freeman, mother of Melvin J. Freeman, for $10,000 on February 6, 1926. To secure the note, Mr. and Mrs. Hein gave a mortgage on the following real estate: The SW-1/4 of section 29, twp. 88 north, range 36. except one acre for schoolhouse. The petition claims the defendants have failed to pay the interest amounting to $500 and also the drainage assessment in 1932, amounting to $209.72, and first half of taxes for 1932 of $138.64, which is included in the foreclosure demand. ![]() Albertus Peters Estate Valued at $13,000 A preliminary inheritance tax report was filed Saturday i the office of Harry E. Thiessen, district court clerk, for the $13,000 estate of Albertus Peters by F. Van Erdewyk, of Breda, executor. Mr. Peters died testate January 20, 1934, at Duncombe at the age of 75 years leaving 20 legal heirs, namely: John Peters, son, Carnarvon; Ben Peters, son, Carnarvon; Maggie Poen, daughter, Lake View; Ben Peters, son, Monroe, S. D.; Herman A Peters, son, Lake View; Grace Klockner, daughter, Fort Dodge. Children of Klaaska Fischer (deceased), namely: Grace Freese, Wall Lake; Albert Fischer, Carnarvon; GeGrd Fischer, Carnarvon; Katie Kluver, Wall Lake; Arthur Fischer, Carnarvon; and Clarence Fischer, of Carnarvon. Kate Kluver's (deceased) children, namely: Grace Coneck, Ulmer; Alberta Tucker, Herring; Klaaska Kluver, Carnarvon; Alvin Kluver, Carnarvon; Ben Kluver, Carnarvon; Henry Kluvr, Carnarvon. One child, Esther Greve, of Ridgewood, New Jersey; the daughter of Dena Greve, a deceased daughter. Among the holdings of the $13,000 estate are the southeast quarter of the northwest quarter and the northwest quarter of the southwest quarter of section 12, township 86 in range 36; containing 80 acres, estimated at $8,000, and $5,000 notes. Only $500 indebtness is listed. ![]() Many New Cases Filed for May Term of Court Bar dockets for the May term of court of the Sac County District Court calendar were distributed the first of this week and court will open on Monday, May 21. The last day of filing was Friday, May 11, and an unusual rush of cases were filed in the office of Harry E. Thiessen, district court clerk. There were 18 new cases filed last week, making a total of 34 new cases for this term of court, which is usually very light, being an equity term. The equity cases noted for trial are as follows: Wm. C. Harms, et al, vs. John Grabow, et al, a suit for specific performance; Ed. V. Johnson vs. Anna Fertig; Marjorie Freeman vs. Dale Freeman, et al, garnishment. The law cases for trial are: Alice Umbarger vs. J. D. Kilbourne, et al., a suit for damages; C. L. Roe vs. E. E. Sheley, a suit on note. Criminal cases noted are: State of Iowa against Otto Jungert for maintaining a liquor nuisance and also for forfeiture; against V. (Buck) Jones for writing worthless check; George Ohlsen for assault and battery and Richard Pierson, et al, for forfeiture. The next term will begin September 4 and August 25 will be the last day of filing. ![]() Store Account of $22.43 Results Into Damage Suit Gilbert Carroll, of Lake View, filed suit in district court last week against E. Reardon, also of Lake View, claiming damages of $110 and costs of action stating that said damages were sustained as a result of the action Reardon commenced against Carroll on April 18 of this year for a store account of $22.43. Carroll claims the action was started in the Justice Court of D. J. Wright of Lake View; that a writ of attachment was issued from this court and attachment was made on Carroll's 1930 Chevrolet truck. Carroll claims the attachment was wrongful as the defendant had no reason to believe he had grounds for such attachment and claims the attachment was far in excess to the amount of judgment in compliance with the state laws. Carroll claims he was willfully and maliciously sued by Reardon and damaged to the amount of $110 and costs. This amount is mostly accounted for in the petition by expenses incurred by releasing the attached property, legal costs of obtaining a constable notice, an affidavit that property was exempt as provided by law. ![]() Starts Foreclosure Action Against Three Sac Co. Farms The Metropolitan Life Insurance Company, of New York City, a corporation, filed a foreclosure suit against Katharine Weitzel, Annis and Rholing Company, Louis P. Weitzel and Anna F. Weitzel, Peter Hansen and Sac County, in which the plaintiff demands judgment of $19,124.85 and interest and costs and demands foreclosure on the SW1/4 of section 32 in twp. 88 north, range 37. The defendants were claimed to have given a promissory note for $16,000 on September 17, 1925. Another foreclosure suit was filed by the same Metropolitan Life Insurance Co. against Duncan Currie and Mary S. Currie; Annis Rohling Co., the First National Bank of Odebolt and Sac county in which they demand a judgment of $21,336.36 and interest and attorney's costs. They also demand foreclosure on the northwest fractional quarter of section six, township 87 norh, range 38. The amount represents a promissory note given on Oct. 26, 1922, for $18,000. Another foreclosure suit by the same company against Nettie A. Cressler and Fred Cressler; Anna J. Cressler; Annis and Rholing Company; The Fairburn Stte Bank, a corporation and Sac county, in which the insurance company judgment of $17,262.43 and interest and costs and demands foreclosure on the NW1/4 of section 14, in twp. 89 north, range 35. The defendants gave a promissory note on February 20, 1925 which was secured by the above real estate. |
