C.C. CONE OF MEMPHIS SUES KEPCKE BAKERY CO.
(Milton Herald)C.C. Cone of Memphis, Mo., last week brought suit in Wapello county district court for $20,000 against the Kepcke Baking Co. of Ottumwa.
The action is the result of the truck-motorcycle accident last September 14, when Pauline Cone, 19 year old wife of Cone was killed. Cone asks the court to award him $10,000 for damages to his wife's estate and a similar amount for damages to himself as the result of the loss of his wife and their unborn child.
When the accident occurred, Cone was driving the motorcycle on highway No. 15 near the Iowa-Missouri line, between Milton and Memphis. Mrs. Cone was riding on the rear seat of the motorcycle when the machine crashed with the Kepcke truck. She lived only about an hour following the accident. The collision occurred about 5:30 in the morning. Mr. and Mrs. Cone were en route to Chicago for a visit at the Century of Progress, it will be remembered here when the accident happened.
The driver of the bakery truck is charged with negligence in not having headlights burning, driving at a too rapid rate of speed, and steering to the left of the center of the road. The petition also states that the morning was foggy.
Mr. and Mrs. Cone had been married three months and two days at the time of the accident.
