AFFIDAVIT: March 6, 1953.

We, Ray Turner and V. Sutphin being first duly sworn each for himself deposes and says:

That we are the persons who entered into a written agreement with Herman L. Spurgeon on April 14, 1952, which agreement is of record in Book U of Miscellaneous Records, page 341, records of Mitchell County, Iowa; that in said agreement we agreed to do certain farm work for Herman L. Spurgeon on the real estate described as:

The E 1/4 of the NE 1/4 23, 100, 15.

That thereafter the said Ray Turner and V. Sutphin canceled said agreement on the margin of the record on December 12, 1952.

That at the time of said agreement the said Herman L. Spurgeon was not the owner of the said real estate, but that he was the renter and said agreement was made only for the purpose of fixing prices for the work to be done for said renter and to give us a lien for our work, thus assuring payment for our work. That we are fully paid for our work and the agreement was thereupon canceled by us.

Subscribed and sworn to this 6th day of March, A.D., 1953.
